The Citizen Entrepreneurial Development Agency (CEDA) has issued a statement acknowledging the recent High Court decision to discharge its application for an interdict against civil activist Setlhomo Tshwanelang. The ruling, delivered by Judge Michael Leburu, dismissed CEDA’s case with costs, emphasizing the importance of transparency and public accountability in governance.

Court Ruling Highlights Transparency

In his judgment, Judge Leburu stated that CEDA failed to demonstrate how Tshwanelang’s posts caused irreparable harm. Instead, the judge highlighted that as a public entity entrusted with significant resources, CEDA must operate transparently and remain open to scrutiny.

“It is in the public interest to know how CEDA is managed in the era of transparency,” Judge Leburu remarked, underscoring that accountability is essential for the common good.

Activist’s Victory for Accountability

Setlhomo Tshwanelang’s attorney, Bakotelo Mmipi, welcomed the ruling, calling it a significant step toward reinforcing transparency and good governance in Botswana. He noted that the decision sets an important precedent, encouraging citizens and activists to hold public institutions accountable without fear of legal retaliation.

CEDA’s Commitment to Openness

In its press release following the court’s decision, CEDA reiterated its respect for the rule of law and reaffirmed its dedication to transparency. The Agency welcomed the Ministry of Finance’s decision to commission a forensic audit into its operations, committing to full cooperation with the authorities conducting the review.

“We view this as an opportunity to further demonstrate our commitment to accountability and ethical governance,” the statement read.

CEDA also emphasized its continued focus on empowering entrepreneurs and fostering economic growth in Botswana. The agency encouraged stakeholders to engage constructively through its established communication channels.

Implications for Botswana’s Governance

The court’s decision is a landmark moment for public accountability in Botswana. It sends a clear message to public institutions about the necessity of operating transparently and withstanding public scrutiny. The judgment may embolden more activists to demand accountability, fostering a culture of openness in the country’s governance framework.

For CEDA, the ruling and the upcoming forensic audit represent a critical juncture. While challenging, these developments provide the Agency with an opportunity to rebuild trust and reaffirm its commitment to serving Botswana’s entrepreneurs effectively and transparently.

As the country moves forward, this case underscores the vital role of judicial oversight and public engagement in ensuring that governance remains a tool for progress and equity.
